What is a Divorce?

Divorce is the legal end of a marriage, also known as the dissolution of marriage. In Australia, divorce operates on a 'no fault' basis. This means that during divorce proceedings, the Court does not require a party to provide reasons why they are asking the Court for a Divorce.

Divorce proceedings are separate from property settlement arrangements, and they need not align. However, it's crucial to note that after divorce, initiating property settlement proceedings is necessary within 12 months of the Divorce Order date.

When can I apply for a Divorce?

If your marriage has irretrievably broken down, you can file for divorce with the Court. This requires a separation from your spouse for 12 months. The 12-month separation period can commence even if you're still residing together but living separately. If you are still residing together the Court will require some additional information.

Divorce proceedings with Children

The Court will require information about your current parenting arrangements if your children are under 18 years old, however, it is important to note that the Court will not make any changes to the parenting arrangements during divorce proceedings.

If you have been married for 2 years or less

If you've been married for two years or less, you have two options before proceeding with divorce, either engage in counselling to explore the possibility of reconciliation with your spouse or submit an affidavit to the Court outlining the reason you cannot attend counselling. Joint Application

A Joint Application for Divorce is where both parties to a marriage apply to the Court for a divorce together.

Price: $2,490 (this price includes the Court filing fee)

Sole Application

A sole application is where one party applies for the divorce without requiring the agreement of the other party.

Price: $2,660 (this price includes the Court filing fee and service (if required))
