FAQs
-
Consent orders are mutually agreed-upon orders between you and the other party, which are submitted to the Court for formal approval. You are not required to attend Court for these Orders.
-
While you're not legally obligated to formalise the agreement with your former spouse, there are several important considerations to bear in mind:
1. If your former spouse fails to uphold the agreement, you won't have the legal means to compel them to fulfill their obligations, unlike with Consent Orders, which are legally binding and enforceable.
2. Your former spouse retains the option to file a court application at a later date to initiate proceedings, subject to certain limitations. In contrast, a Consent Order is final and designed to sever all financial ties between parties.
3. When transferring property between you and your former spouse, a Consent Order allows for the transfer of title without incurring stamp duty costs, providing a more efficient and cost-effective process
